When Can I File for Divorce?

Before filing for Divorce it is important to make sure that you meet all of the "residency" requirements under the Texas Family Code. Residency requirements are in place to make sure that individuals are filing both in the proper State as well as the proper County. In Texas, with some exceptions, you must file in the county where either you or your spouse has lived for at least 90 days prior to the date you file. In addition to you or your spouse residing in the county where you file, one of you must also have lived in Texas for the six months leading up to the date you file. So, if neither you or your spouse has lived in the State of Texas continuously for the six months leading up to your filing date, Texas may not be the appropriate location to file. Alternatively, you may need to wait for a period of time before filing would be proper in Texas.
